Justin & Janet: Out of Control

By Marcus Errico

Forget that Britney-Madonna (news - web sites)-Christina three-way
lip-smackdown--Justin and Janet just one-upped it with a very, well, titillating
halftime performance at Super Bowl XXXVIII Sunday.

Football fans--and shocked producers--got an unexpected eyeful during the grand
finale of Timberlake and Jackson's halftime-ending duet when the 'N Syncer
grabbed Jackson's outfit and yanked off a patch of leather covering Jackson's
right breast, briefly exposing her mammary to some 130 million viewers.

Many of those viewers were none too pleased about the action on the boob tube
and they quickly phoned CBS to voice their displeasure. The network said it had
fielded "several" irate calls after the halftime spectacular, which was produced
by CBS' corporate kin MTV and also featured less revealing numbers by Nelly, P.
Diddy and Kid Rock.

"CBS deeply regrets the incident," the network said in a press release.

Considering Jackson and Timberlake's bump-and-grind performance, their cozy
off-stage relationship--they were briefly linked romantically following his
bust-up with Spears--the fact that Jackson appeared to be wearing a star-shaped
pasty over her nipple and MTV's reputation for too-hot TV moments, many viewers
believed the incident to have been staged. (Heck, it was more exciting than the
first two quarters between the New England Patriots and Carolina Panthers.)

But all parties concerned denied the breast incident was preplanned.

CBS, which quickly cut away from the R-rated shot, said its executives had
monitored rehearsals all week, "and there was no indication any such thing would
happen. The moment did not conform to CBS' broadcast standards and we would like
to apologize to anyone who was offended."

MTV concurred, saying, "The tearing of Janet Jackson (news)'s costume was
unrehearsed, unplanned, completely unintentional and was inconsistent with
assurances we had about the content of the performance. MTV regrets this
incident occurred and we apologize to anyone who was offended by it.

Timberlake also offered something resembling an apology. "I am sorry that anyone
was offended by the wardrobe malfunction during the halftime performance of the
Super Bowl," he said in a statement. "It was not intentional and is regrettable."

But, malfunction or otherwise, the NFL wasn't in a forgiving mood. "We were
extremely disappointed by elements of the MTV-produced halftime show," Joe
Browne, NFL executive vice president, said--and we don't think he was referring
to Nelly and Diddy's rendition of "Hot in Herre."

"They were totally inconsistent with assurances our office was given about the
content of the show," he continued.

"It's unlikely that MTV will produce another Super Bowl halftime."

Nonetheless, Breastgate has given Jackson all kinds of free publicity as she
prepares to release the single, "Just a Little While," off her new album, Damita
Jo. The single hits radio stations Monday (and, according to a statement Sunday
from label Virgin, "comes on the heels of Janet's triumphant return to the
spotlight with her performance as the featured artist at today's Super Bowl");
the album drops March 30.

Jackson wasn't the only one showing off her assets Sunday. Perhaps inspired by
the Justin-Janet show, and despite heightened security, a streaker ran out on
the field at Houston's Reliant Stadium just before the kickoff of the second
half. This time, though, CBS producers managed to avert another candid-camera
incident and zoomed out from the field before the man came into focus.

And the action on the field finally lived up to the halftime fireworks, as New
England won on a last-second field goal, 32-29.

Now the FCC is getting involved, another story on this.

Associated Press
NEW YORK -- The chief federal regulator of broadcasting was outraged by the Super Bowl halftime and ordered an investigation after part of Janet Jackson's costume was torn off, exposing her breast.

Justin Timberlake said he did not intend to expose Janet Jackson's breast during the halftime show.

Singer Justin Timberlake ripped off a piece of Jackson's outfit and blamed a "wardrobe malfunction," but Federal Communications Commission chief Michael Powell on Monday called the display "a classless, crass and deplorable stunt."

MTV, which produced the show, and CBS, which broadcast it, both said they had no idea the halftime show Sunday night would include such a display.

"CBS deeply regrets the incident," spokeswoman LeslieAnne Wade said.

The two singers were performing a flirtatious duet to end the halftime show, with Timberlake singing, "Rock Your Body," and the lines he sang at the moment of truth were: "I'm gonna have you naked by the end of this song."

Timberlake then reached across Jackson's leather gladiator costume and pulled off the covering to her right breast, which was partially obscured by a sun-shaped, metal nipple decoration. The network quickly cut away and did not mention what happened on the air.

"I am outraged at what I saw during the halftime show of the Super Bowl," FCC Chairman Michael Powell said in a statement. "Like millions of Americans, my family and I gathered around the television for a celebration. Instead, that celebration was tainted by a classless, crass and deplorable stunt. Our nation's children, parents and citizens deserve better."

He told the commission to open an investigation, promising it would be "thorough and swift." Such an investigation could result in a fine of up to $27,500 or -- if the FCC applied the sanction to each CBS station -- in the millions.

Stir comes past president's bedtime
The halftime show didn't cause a stir at the White House because President Bush fell asleep.

"I don't want to admit it, but because this White House starts early, I missed it -- again," he told reporters Monday after a Cabinet meeting. "Saw the first half, did not see the halftime -- I was preparing for the day and fell asleep."

Messages left with Jackson's record company and her personal publicist were not returned Monday morning.

At the White House, President Bush said he missed the show.

"Saw the first half, did not see the halftime -- I was preparing for the day and fell asleep," he told reporters Monday after a Cabinet meeting.

White House spokesman Scott McClellan said: "Our view is, it's important for families to be able to expect a high standard when it comes to programming."

The FCC has come under fire from lawmakers and outside groups who say the agency hasn't done enough to shield the public from indecent programming on radio and TV.

Legislation has been introduced in Congress to increase by 10-fold the $27,500 maximum fine that the FCC can levy for indecency. The Bush administration has endorsed the bill raising the fine to $275,000. The agency itself has said it may start issuing the fine per incident rather than per program, and is talking about revoking licenses.

Last month, the FCC proposed a $755,000 fine against Clear Channel Communications for the "Bubba the Love Sponge" program that aired multiple times on four of its Florida radio stations. The fine was a record for a single complaint. The largest cumulative fine for indecency was $1.7 million paid by Infinity Broadcasting in 1995 for various violations by Howard Stern.

MTV, CBS' corporate cousin in Viacom, issued a contrite statement in which it also apologized, saying the display was "unrehearsed, unplanned, completely unintentional and was inconsistent with assurances we had about the content of the performance."

Timberlake said he did not intend to expose Jackson's breast and was "sorry that anyone was offended by the wardrobe malfunction."

"It was not intentional and is regrettable," he added.

Wade said CBS officials attended rehearsals of the show all week, and "there was no indication any such thing would happen. The moment did not conform to CBS' broadcast standards." The show also featured P. Diddy, Nelly and Kid Rock.

NFL commissioner Paul Tagliabue called the conduct "offensive, embarrassing to us and our fans, and inappropriate."

"We will change our policies, our people and our processes before the next Super Bowl to ensure that this entertainment is far more effectively dealt with," he said.

Over-the-air television channels cannot air "obscene" material at any time and cannot air "indecent" material between 6 a.m. and 10 p.m. The FCC defines obscene material as describing sexual conduct "in a patently offensive way" and lacking "serious literary, artistic, political or scientific value." Indecent material is not as offensive but still contains references to sex or excretions.

In an interview posted on MTV.com in the days before the show, Jackson's choreographer, Gil Duldulao, talked about the show, saying: "She's more stylized, she's more feminine, she's more a woman as she dances this time around. There are some shocking moments in there, too."

I think that if the FCC wants to fine CBS for that then they need to take NYPD Blue of the air because I have watched that show and have seen butt shots and a man and a women doing it and showing the facial expressions so what is a little bit of breast when the nipple was covered I say "give me a break."

I dont know about a few.  The roughing the passer call maybe, but nothing like the other Super Bowl.  If the refs were actually in on the fix I think they wouldve given Roethlisberger the first touchdown because it was a fairly difficult call to make.
